Model Publication Release Form

By filling out this digital release form, I (Name listed below) hereby consent for the value received and without further consideration or compensation to the use (whole or in part) of the images submitted by the Photographer (Name listed below) to Live Your Dream Model Publications, its owners, directors, officers, employees, affiliates, and representatives (hereafter referred to as the “Company”) to use, copy, edit, distribute, publish and transmit their submitted works publicly or privately, including posting it on the any of Live Your Dream Model Publications magazines, websites, calendars, newspaper, and social media.  The Photographer retains complete copyrights of all materials submitted.  The material can be used for the mentioned projects and promotions in relation.  I understand that once the publication is released, it will be pulled back or revised under no circumstance.

Sworn Statement: Under 28 U.S.C. 1746 and the penalty of perjury under the laws of the United States, I swear that the foregoing is true and correct and that each of the Identification documents which I have provided and of which I have signed the attached copy was lawfully obtained by me and has not been forged or altered.

 I hereby agree and state that:
1.  This Release form will cover all my submission/s by the Photographer or the Model to the Company.

 2.  At its discretion, the Company may be interested in using the Content in whatever media form it chooses. The images submitted will only be published in the publications selected by the Model in the “Publication/s in which you are interested in being published.”

 3.  I understand the copyright of the images that Live Your Dream Model Productions, LLC is publishing are owned by the Photographer.  The publication of the pictures does not impact the Photographer’s copyright ownership.

 4.  At its discretion, the Company may use all or parts of the Social Media information submitted by the Model in the publication.

 5.   I will defend, indemnify and hold the Company and its owners, affiliates, directors, officers, employees, suppliers, consultants, contractors, and agents harmless from and against any and all actual or threatened claims, suits, actions, or proceedings, including all related damages, payments, deficiencies, fines, judgments, settlements, liabilities, losses, costs, and expenses (including but not limited to reasonable attorneys' fees) (collectively, "Claims") arising out of or relating to (a) my breach of this agreement or any representation or warranty made by me herein; (b) my negligence or willful misconduct; (c) the Content (including, without limitation, Claims alleging that the Content violates or misappropriates the intellectual property rights or other rights of any third party) ; and/or (d) any violation of any law by me.

 6.  I understand that once printed or downloaded, the Content is embedded perpetually in the end-user copy of the Content, with no way for the Company to retrieve or stop access to the Content; hence the perpetual release of rights is essential for the Company to use my Content in its publications in any medium or format.

 7.  I understand and agree that the Company does not supply a free copy of the Magazine, PDF Format, or any other Publication.  I am responsible for purchasing any issue(s) and copy(ies).  Neither MagCloud nor Live Your Dream Model Productions, LLC, gives refunds on the sale of the publications, and all sales are final.  In addition, I understand and agree that the Company will provide tear sheets of the images published in the magazine and that there will not be any other compensation for me or any individuals in the Content submissions.

 8.  I agree that I have reviewed the original Content submission(s).  All persons depicted or who participated in creating the Content submission(s) are over the age of 18 and have total legal capacity.  I further understand that the Company requires proof of age via either a valid Driver’s License or valid Passport of all persons depicted or who participated in creating the Content at any time.  I understand that this certification shall also apply when the owner/copyright holder is depicted in the Content submission(s).

 9.  Governing Law; Venue.  This agreement will be governed by and construed following the laws of the State of Florida, U.S.A., without regard to its conflict of law principles.  The parties irrevocably consent to the jurisdiction of the state and federal courts in Hillsborough County, Florida, U.S.A., to resolve any disputes or conflicts arising from or related to this agreement.

AGE VERIFICATION INFORMATION:
As stated in the Model Publication Release, you need to send Live Your Dream Model Productions, LLC  a picture of a legal ID (Driver’s License or Passport) for Age Verification.  You can send it via Email, Facebook or Text .    Failure to do so will result in your submission being denied publication.  This is necessary for legal matters. We need to ensure all Models submitting images are 18 years of age or older, if you are not it is illegal for any publication to publish your work without parental consent.  Any and all publications are required by law to ensure proof of age.

PHOTOGRAPHER'S CONSENT:
We accept images submitted by Models, however, the Photographer needs to complete a Photographer Publication Release in order for the images to be published.  Photographers own the images copyright and they need to give the publication permission to publish their work.  Even if the Model has paid to have ownership of the images,  it does not matter to us.  We still need the photographer to give us permission to publish their work.  That is the legal, ethical and correct thing to do.
